Discretionary Will Trust

This is a special type of Will where you are not sure who you wish to inherit, when you wish them to inherit or on what conditions. Often there is a real need for giving someone else the power to make those decisions for you after you have gone.

For couples we have a special version of the Discretionary Will Trust called a Family Will Trust. Often the husband dies first and leaves everything to the widow who then goes into care. This is a one in four risk. Then the whole estate is vulnerable for care costs.

However with this inexpensive Trust, the husband’s half would be in trust for the benefit of the widow but not actually in her name. It is a cost effective and ethical way to reduce or even avoid altogether the care costs.

Costs?

Discretionary Will Trust – one person – £400

Family Will Trust – couple – £1,080

Appointments are available at our Sutton Coldfield, Kings Norton or Shard End locations. We also have appointments at other locations across Birmingham on an ad-hoc basis. Home visits are also available.

Life Interest Wills

This is a special type of Will where you want to leave your assets to certain beneficiaries but also want one individual to have the benefit of those assets (including the right to live in your property) until they die. This type of Will can also be useful for inheritance tax avoidance.

For couples we have a special version called a Family Will Plan. With this Plan the husband’s half of the house would be left to the children with the widow having a right of occupancy in the property. It can be tailored to suit individual circumstances. It is another cost effective way to reduce or even avoid care costs altogether. It is not as good as the Family Will Trust but it is a cheaper alternative.

Half Price Lasting Powers of Attorney

It is important that every adult should have a Power of Attorney. More people need a Power of Attorney these days. This lets someone you trust look after you and your affairs if you are not able to do so. Without a Power of Attorney your family might need to go to Court which is expensive and takes a long time. With this in mind Age Concern Birmingham has partnered with McClure Solicitors to offer its supporters a half price Lasting Power of Attorney service. Just consider making a donation for Age Concern Birmingham.

McClure will prepare your Lasting Power of Attorney for just £180 instead of the usual £360. And they’ll even include a Welfare Power of Attorney free of charge. All you need to do is consider making a donation to help support Age Concern Birmingham.

Using the services of McClure Solicitors means that come what may, you will have your affairs in order.

General Power of Attorney

It sometimes happens that important documents need to be signed or decisions made when you are likely to be away perhaps with work or on holiday.

A general Power of Attorney gives someone you trust full authority to make these decisions for you and to sign documents on your behalf. A common example is the sale of a property concluding when you are likely to be abroad.

Age Concern Birmingham is partnered with McClure Solicitors to provide this service to its supporters.

Appointments are available at our Sutton Coldfield, Kings Norton or Shard End locations. We also have appointments at other locations across Birmingham on an ad-hoc basis. Home visits are also available.

Deputyship

Age Concern Birmingham has partnered with McClure Solicitors to offer a Deputyship service to all its supporters.

If someone close to you loses the capacity to make decisions or sign documents i.e. becomes incapax, first check to see if they have an Enduring Power of Attorney or a Lasting Power of Attorney. If they don’t, all is not lost. The Court of Protection can grant a one-off order to enable you to make a single important decision. However usually you will need more than that. The Court of Protection can then appoint you as the deputy to make decisions. This can be for property and financial affairs. Or personal welfare. Or indeed both.

Age Concern Birmingham would like to encourage all its supporters who find themselves in this position to use the McClure Deputyship service.

Appointments are available at our Sutton Coldfield, Kings Norton or Shard End locations. We also have appointments at other locations across Birmingham on an ad-hoc basis. Home visits are also available.

Probate

When someone dies it is important to find out whether the probate procedure is required or not. When the first partner dies, probate is often needed but is often overlooked and only raises its head on the death of the survivor. This causes real problems.

Probate is the official procedure by which the executors obtain authority to deal with the deceased’s estate. It involves real responsibility and can be complex.

With this in mind Age Concern Birmingham is partnered with McClure Solicitors to offer its supporters their Express Probate Service.

McClure Solicitors have been administering estates since 1853. Their determination is to complete the process as quickly and economically as possible. That is what families want.

Age Concern Birmingham would like to encourage all its supporters to contact McClure Solicitors when a loved one dies, to find out if probate is needed and, if so, to use their Express Probate Service.

Appointments are available at our Sutton Coldfield, Kings Norton or Shard End locations. We also have appointments at other locations across Birmingham on an ad-hoc basis. Home visits are also available.
